Dual agency (where the licensee represents both the buyer and seller in the same transaction) is not dead, but does pose some dilemmas and conflicts for the real estate practitioner.  Some of these conflicts are so subtle that they may be unrecognizable by even the most diligent licensee.  This class will show you how to recognize the traps before you get there, and how to avoid them.

This is an interesting alternative to a 1031 exchange.  This technique allows a seller to receive a tax deduction, as well as a sale without tax consequences, by using a charitable remainder trust.  The best part is (under certain circumstances) you only have to give 10% of the asset to the charity.  It’s all perfectly legal and it’s been around since 1969.  Ivan will also discuss the pitfalls of owning real estate in your IRA or 401K plan.

This is an intense class, which covers all of the pertinent laws, Commissioner’s Rules, and Commissioner’s policies which addresses the obligations that are required of Managing Brokers.  The course includes the 40- plus page office policies manual handout and covers the Commissioner’s Rules and policies with a focus on the required Broker Office Policies Model Manual.    ALL DESIGNATED BROKERS are required to take this class at least once every two years.

Environmental issues are on everyone’s mind.  Even though a real estate licensee is not expected to have the technical expertise necessary to determine whether environmental hazards exist on the property or not, an agent needs to be aware of what might be considered to be an environmental concern.  John will explain some of the current and significant environmental issues, the “red flags” which may or may not be apparent, and the agent’s responsibilities to disclose the possibility or need for further investigation by the parties.

HOME INSPECTIONS: WALKING THE FINE LINE

Home inspectors are between a rock and a hard place with every assignment.  They want your continued business, but at the same time, they must be competent by noting material defects and yet not be a nitpicker.  Tony will point out the various elements of “Green Construction” and in a slide show he will demonstrate how green building can make a big difference in operating costs.   You’ll see pictures of easily overlooked (and some obvious) defects, which could have a major effect.
